Terms of Service
These Terms of Service ("Terms") are an agreement between you and Moves ("Moves," "we," "us," or "our") and govern your use of the Moves mobile application and website at moves.nyc (together, the "Service"). Moves is an event discovery service for New York City, operated by Vagabond Labs, Inc. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
Eligibility
The Service involves nightlife and events content and is intended for adults. You must be at least 17 years old to use it. By using the Service, you represent that you are 17 or older and that you are able to enter into this agreement.
The service
Moves helps you discover events happening in New York City. Event information — including times, dates, prices, lineups, and venue details — comes from third-party sources such as public listings, venues, promoters, and ticketing platforms. We work to keep it accurate, but we cannot guarantee that any listing is accurate, complete, or up to date. Events get moved, canceled, and sold out; prices change. Always verify the details with the venue or ticket seller before you go.
Moves does not sell tickets. When you tap through to buy a ticket, you are purchasing from a third-party site under that site's own terms. Moves is not the seller, does not process the payment, and is not a party to that transaction. Any issues with a purchase — refunds, entry, event changes — are between you and the ticket seller or venue.
Accounts
You sign in with your phone number or email address using a one-time passcode. You agree to provide accurate information, to keep your sign-in method secure, and to maintain only one account. You are responsible for activity that happens under your account. We may suspend or terminate accounts that violate these Terms. You can permanently delete your account at any time from within the app, under Settings, then Delete Account.
User content & community guidelines
After attending an event you can post reviews, ratings, and vibe tags, along with an optional written note, a username, and a profile photo (together, "your content"). You own your content and you are responsible for it. Public ratings are new-school word of mouth — honest, first-hand, about the night itself — and a few rules keep them worth reading.
Reviews describe the event. Say what the night was actually like — the crowd, the sound, the room. That's what makes ratings useful. Reviews that are about something else (a grudge against a person, an unrelated rant) get removed.
You can add photos to a review, and they're part of your content under the same rules — nothing objectionable, and they come down when the review is reported and removed.
No harassment. Don't target people — other users, artists, staff, anyone. No hate, no threats, no doxxing. Criticize the party, not a person.
No spam or self-promotion. Don't use reviews to promote your own event, drop ticket links, or astroturf a venue. One genuine rating from a real night out beats ten planted ones.
We have zero tolerance for objectionable content and abusive users. Content that is harassing, hateful, threatening, obscene, sexually exploitative, or that impersonates another person will be removed, and the account behind it may be terminated immediately, without warning. You can report any review using the flag on it and you can block other users. Every report is reviewed, and we act on violations within 24 hours by removing the offending content and, where warranted, removing the user who posted it.
License to your content
So we can operate the Service, you grant Moves a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute your content in connection with running and promoting the Service — for example, showing your public review and username on an event page. This license ends when you delete the content or your account, except for the short time it takes copies to clear from backups and caches.
Prohibited conduct
You agree not to misuse the Service. That includes: using it for anything illegal; scraping, harvesting, or bulk-downloading data from it; interfering with or disrupting the Service or its infrastructure; attempting to bypass security or access accounts or data that aren't yours; creating accounts by automated means or under false pretenses; impersonating any person or misrepresenting your affiliation with anyone; and reverse engineering the app except where the law says we can't stop you.
Intellectual property
The Moves name, logo, design, and software are ours and are protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the app and site for your own non-commercial use. Event names, images, and related materials belong to their respective owners; their appearance on Moves doesn't imply any endorsement.
Third-party links and services
The Service links out to third-party sites and services — ticketing platforms, venue pages, maps, and social profiles. We don't control them and aren't responsible for their content, terms, or privacy practices. Your dealings with any third party are solely between you and them.
Disclaimer of warranties
The Service is provided "as is" and "as available." In plain English: we don't promise the Service will always be available, error-free, or uninterrupted, and we don't promise that any event listing is accurate. Where you go and what you do at an event is your decision and your responsibility.
Limitation of liability
To the fullest extent permitted by law, Moves will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from events you attend, tickets you purchase from third parties, or content posted by other users. To the same extent, our total liability for any claim relating to the Service is capped at one hundred US dollars (USD $100). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
